Information Request sent to USRAP South Africa
To assist individuals navigating this complex process, we respectfully request clarification on the following matters. These are recurring questions raised by prospective applicants, and clear guidance would help prevent misinformation and procedural delays.
Eligibility of South African H2A/B Workers Currently in the United States
- Many seasonal and agricultural workers currently in the U.S. on valid H-2A or H-2B visas have expressed interest in submitting a Statement of Interest under USRAP South Africa. However, there is uncertainty around:
a) Whether they are required to apply for asylum while in the U.S.;
b) Whether they must return to South Africa (or elsewhere) to apply as refugees;
c) Whether any special dispensation applies to their temporary work status;
d) Whether family members remaining in South Africa may apply independently and if this should be done with or without their involvement. - Dual Passport Holders (Primarily British-South African Nationals)
Some South African-born applicants hold a second passport, most commonly British, but have never lived or sought protection in the United Kingdom or elsewhere. Based on the USRAP criteria published on 12 May 2025, we understand that dual nationality alone does not constitute firm resettlement. However, we would appreciate confirmation on whether the mere possession of a second passport could render such applicants inadmissible or deprioritized under USRAP. - Vaccination Requirement for Refugee Entry
Following the 1 May 2025 announcement by Secretary RFK Jr. regarding a review of vaccine safety, many South Africans have questions about the vaccination requirements for refugee entry into the United States.
While the USCIS Policy Manual (https://www.uscis.gov/policy-manual/volume-8-partb-chapter-3) states that vaccinations are not required for refugee admission but are necessary at the adjustment of status stage, can you kindly confirm:
a) Whether routine childhood or influenza vaccinations are required prior to entry under USRAP;
b) Whether individuals lacking proof of vaccinations may still be eligible to travel under refugee status and comply later during adjustment.
