SARS Is Coming for You — Here’s How to Stop Them Legally

Whether you are in South Africa or living abroad, if you or your company owe SARS taxes or have outstanding returns, SARS will be looking for you soon — if they have not found you already.

Why You Are in the Crosshairs

When the Minister of Finance could not push through a 2% VAT increase, it left a R75 billion hole in revenue, on top of the usual annual tax collections. SARS offered to close the gap through aggressive collection. Government immediately gave them R3.5 Billion and will add another R4 Billion in the next few years. That is a R7.5 Billion war chest for one of the most aggressive tax collection drives South Africa has ever seen.

What the First R3.5 Billion Is Funding

  • More external collection agents — Over 800 agents appointed in 2024/25, with 1 700 more in training and more agents due to be appointed by early 202 This is on top of SARS’s internal collection staff.
  • AI-driven monitoring — SARS links data from banks, retailers, debtors, Natis, the Deeds Office, salaries, and more, giving them a real-time view of your financial life.
  • Offshore asset tracking — Leaving South Africa does not put you beyond SARS’s reach unless you financially emigrate. Through the Automatic Exchange of Information agreement (AEOI) between tax authorities worldwide, SARS can now track your personal data as well as income and assets across borders. What This Means for You

If you have unpaid taxes or outstanding returns, it is only a matter of time before SARS will get hold of you and, once they do, they do not let go easily unless you stop them.

Your Options

You have only two options:

  1. Pay SARS — If you can pay the debt, settle in full as soon as possible, enter into a deferred payment plan or apply for a compromise. Keep in mind that payment plans and compromises often fail because of SARS’s unrealistic repayment demands and take long to establish, while the penalties and interest still.
  2. Get rid of the debt lawfully if you cannot pay—
  • Company Liquidation stops SARS and other creditors from pursuing your company and writes SARS and all other debts off for the com You can register a new company and continue trading during the liquidation, giving you a clean slate to trade without any business debt. (The only taxes that are not written of are customs and excise taxes).

You will only pay about 30% of your debt— writing off about 70% permanently, so creditors (inclusive of SARS) cannot collect any shortfalls from you ever again.

SARS’s collection power is at an all-time high, backed by a desperate government and a well-funded war chest. Acting quickly is crucial as ignoring it is at your own peril.
